The development of this website and database is a response to the business community, and SMEs in particular, who have voiced concern that they are often excluded from the early stages of policy development, regulatory implementation design, and evaluation of existing regulation. SMEs have proved difficult for government agencies to consult with due to their small size and diversity.

The purpose of the Business Consultation Website is to collect a register of people with an interest in business who are willing to be consulted on business-related policy development, regulatory implementation design, and evaluation of existing regulation. The results of this consultation could usefully inform Regulatory Impact Statements and Business Compliance Cost Statements.

The consultation section of the website contains registration, information, notification of consultation and application for consultation information. The submission section of the site allows business people to make submissions about regulatory issues that impact their business and allows them to offer solutions to their concerns.

The database has two types of members. Direct Consultants: members whose details will be supplied to an agency when a consultation request from the agency matches both the agency's and database member's criteria. Indirect Consultants: members who will be notified by email when consultation documents meeting their criteria are posted on an agency's website.

When an agency requests that www.businessconsultation.govt.nz sends a "Public Consultation" email notification to database members, the link to the consultation documents and the "Text for Public Consultation" will be publicly available to any visitors to the website.

Consultation Process

When an agency wishes to use the database it makes a request to MED, clearly identifying the subject area. MED will:

  • Send the agency a list of direct consultant members whose criteria matches the consulting agency's and/or
  • Post the link to the agency's consultation documents (with the requesting agency's approval) on the notification page of the site and
  • Send a notification email with a link to the agency's consultation documents to indirect consultant members whose "Areas of Regulatory Interest" match the consulting agency's criteria.

Communication with the list of direct consultant members of the database supplied by MED is the responsibility of the consulting agency and any further information the agencies require can be directly requested by the agency concerned.

Email notification of the consultation will provide indirect consultant members with some details of the consultation and a link to the consultation documents on the consulting agency's website.

Agencies wishing to consult with members of the database will need to complete a Consultation Database Request form. This form will allow the database to match requests with database members.

Database members' names will only be provided to agencies for the purpose of consultation on business-related regulation and policy development. This rule will be strictly enforced.

Agencies can use the supplied data only once and are not allowed to supply the data to any other entity. This rule will be strictly enforced.
